Bob Wyatt has
been recognized by his peers in the Daily Journal as one of the
top three environmental lawyers in California.
Bob is a partner
located in the San Francisco office. Mr. Wyatt has concentrated
his practice in environmental law for over twenty-five years.
The scope of
his practice includes environmental compliance counseling under
all federal and state environmental statutes; permit acquisition;
environmental due diligence and negotiations in mergers and acquisitions,
and real property transactions; Brownfields regulatory clearances;
federal and state Superfund and hazardous waste cases; and counseling
and litigation under California's Proposition 65.
Mr. Wyatt's
long term clients include Fortune 500 companies in the industrial,
real estate, financial institutions, agricultural, mining, pharmaceutical,
chemical, electronics, and construction materials sectors, as well
as public agencies. He has overseen environmental review in the
acquisition of a portfolio of over 2700 properties, the largest
such transaction in California's history.

Professional
Background
|
|
In the period
of 1979 to 1984, Mr. Wyatt served as Deputy Regional Counsel and
Acting Regional Counsel for the U.S. Environmental Protection Agency,
Region 9, with jurisdiction over California, Nevada, Arizona, Hawaii,
Guam, American Samoa and the Commonwealth of the Northern Marianas.
During his tenure he was responsible for implementing legal provisions
of the federal Superfund and hazardous waste programs as well as
enforcement actions under the federal Clean Water Act. He was also
tasked with coordinating the federal environmental statutes and
programs with state and local agencies. From 1984-85 he held the
position of Special Counsel for Regulatory Affairs and Director
of Government Relations for Castle & Cooke.
Mr. Wyatt is
admitted to practice in all California state courts; the United
States District Courts for the Northern and Eastern Districts of
California; the United States Court of Appeals for the Ninth Circuit;
the District of Columbia; the Territory of Guam; and The Commonwealth
of the Northern Marianas. He is a member of the American Bar Association
Natural Resources, Energy and Environmental Law Section; the California
State Bar Association, the Bar Association of San Francisco; and
the Environmental Law Institute.

with the Federal Water Pollution Control Action ("FWPCA")

Legal advice
to Central Contra Costa Sanitary District regarding FWPCA Title
II Construction Grant Funding for sewage treatment plant (1974-77)
Plaintiffs'
counsel in Gonzalez v. Costle, suit against EPA on behalf of the
Bay Area Sanitary Sewage Agencies ("BASSA") alleging violation of
FWPCA Section 208 areawide wastewater planning requirements (1977-78)
Prosecution
on behalf of EPA of violations of NPDES Discharge Permits against
City of Los Angeles, City of San Francisco, County of Maui and other
municipal and industrial dischargers (1979-84)
Representation
of City of Las Vegas regarding NPDES Permit terms and conditions
in actions taken by EPA and State of Nevada (1985-90)
Defense of
Bumble Bee Tuna and Air Liquide alleged NPDES discharge violations
in Puerto Rico (1987-89) ? Challenge on behalf of Puma County, Arizona
against EPA for overly restrictive NPDES Permit Discharge Limitations
and Conditions (1989)
Defense of
FWPCA Citizen Suit by Sierra Club against City and County of Honolulu

Education
|
|
Mr. Wyatt received
his law degree in 1975 from Boalt Hall, the University of California
at Berkeley, and also holds a Ph.D. and M.A. in English and American
Literature from the University of Oregon (1969). He was awarded
his B.A. from San Francisco State University in 1964, and received
his secondary education at The Lawrenceville School.
